VIRGINIA PROSTITUTION, SOLICITATION & PANDERING DEFENSE LAWYERS

DEFENDING PROSTITUTION CHARGES THROUGHOUT VIRGINIA

In Virginia, a prostitution solicitation conviction is not available without the prosecution’s proving beyond a reasonable doubt that the defendant gave or offered money or its equivalent for penetrative sex either by vaginal, oral or anal intercourse, and does a substantial act in furtherance thereof. Due to the fact that courts treat offers for sexual favors for money with the same penalties as if the acts take place, sting operations are common in Virginia. So in order to be guilty of prostitution, the prosecutor must prove that someone either had sexual contact for money or offered to have sexual contact for money and then did a substantial act toward that end.

However, if someone just offers a sexual act for money and then walks away without expecting the other person to follow, it would not be prostitution because there was no substantial act that furthered the offer. Under Virginia laws, a sexual act or crime against nature that one performs for monetary reward, financial gain or other valuable compensation constitutes prostitution. The issue of whether or not to legalize prostitution concerns not only moralist groups, religious sectors or politicians, but also every civilian. As a criminal lawyer, state laws are of great importance. It is of common knowledge that changes in relation to law may positively or negatively affect the people it governs.

Prostitution laws in Virginia prohibit anyone from providing or offering to provide sexual conduct in exchange for money or any other form of compensation. They also punish those who offer sex for money or who purchase any sexual service. Virginia laws are so strict on prostitution that you could even be charged if no sex took place. This is where a Virginia prostitution attorney comes in working to make sure that your rights are protected and that you receive a strong legal defense.

Prostitution is a Class 1 misdemeanor in Virginia, punishable with up to 12 months in jail and/or a maximum fine of $2,500. Most cases involving prostitution charges do not involve a woman standing on a street corner flagging down cars. Virginia Beach undercover vice officers have become very skilful at setting up sting operations by responding to advertisements on craigslist or backpage. Under Virginia law, the undercover officer may engage in most activity in pursuit of investigating prostitution charges.

Virginia Code 18.2-347 defines what keeping, residing in or frequenting a bawdy place is.  Bawdy place is defined in this code section.  The following is the statute for residing in a bawdy place.  Keep in mind that this charge is a class 1 misdemeanor in Virginia.

It shall be unlawful for any person to keep any bawdy place, or to reside in or at or visit, for immoral purposes, any such bawdy place. Each and every day such bawdy place shall be kept, resided in or visited, shall constitute a separate offense. In a prosecution under this section the general reputation of the place may be proved.

As used in this Code, “bawdy place” shall mean any place within or without any building or structure which is used or is to be used for lewdness, assignation or prostitution.

The rules of evidence can be difficult to follow, but it is important to understand the type and amount of evidence that will be utilized by the prosecution. The strength of the evidence is the strength of the prosecution’s case.
